Lavender Waves Farm, LLC
General Visitor Agreement, Animal Interaction, and Liability Waiver
Statutory Notice Under Rhode Island Law (R.I. Gen. Laws § 2-23.3-2)
"An agritourism activity sponsor, agritourism professional, or any other person or entity, shall not be liable for an injury to or the death of a participant resulting from the inherent risks of agritourism activities unless the agritourism activity sponsor, professional or other person or entity are demonstrated to have failed to exercise due care under the circumstances towards the participant." By signing below, you acknowledge that you are fully aware of these inherent risks and agree to release the farm, its owners, and its agents from liability to the maximum extent permitted by law.
1. Applicability of Agreement
This agreement applies to any and all entry onto the property of Lavender Waves Farm, LLC, regardless of the date, time, or purpose of the visit. This includes, but is not limited to, general public admission, peak bloom events, agricultural harvesting (pick/cut-your-own), and private scheduled events (such as weddings, birthday parties, anniversaries, bridal showers, and corporate gatherings).
2. Acknowledgment of Specific Farm Hazards & Animal Risks
By entering the property, I acknowledge and fully understand that Lavender Waves Farm, LLC is a working agricultural and livestock environment. In accordance with Rhode Island law, I explicitly acknowledge, appreciate, and accept the following inherent risks and hazards:
- Large Animals & Livestock (Camels, Alpacas, Llamas): I understand that large, powerful livestock are present on the farm. They may be interacting freely in guest areas, tied to posts, led on ropes, or accessible in adjacent pastures over fencing. I acknowledge that these animals are unpredictable and possess the capacity to kick, spit, bite, step on, charge, or cause serious bodily injury to visitors.
- Animal Feeding: I understand that purchasing feed and hand-feeding camels, alpacas, and llamas carries an inherent risk of accidental bites, pinches, scratches, or aggressive animal behavior over food resources.
- Free-Roaming Birds: I acknowledge that a variety of free-roaming poultry and avian species — including chickens, ducks, guinea hens, geese, and peacocks — are at large on the property and may scratch, peck, or chase visitors.
- Working Farm Dogs & Cats: I understand that the farm utilizes free-roaming, working Livestock Guardian Dogs to protect the property and livestock, as well as a barn cat. I agree to treat them with respect, maintain a safe distance, and never provoke them.
- Lavender & Agricultural Harvesting Tools: I acknowledge that harvesting activities involve sharp instruments. This risk applies whether I utilize my own personal tools brought from home or sharp equipment lent by the farm (including, but not limited to, scissors, shears, pruners, or sickles). I accept the direct risk of cuts, punctures, or other bodily injuries from these tools.
- General Farm Terrain & Bees: I accept that the terrain includes rural elements such as uneven ground, hidden holes in the grass, mud, gravel, and exposed rocks. I also acknowledge that bees, wasps, and other stinging insects are heavily present around the farm plants and are vital to the ecosystem.
3. Assumption of Risk and Release of Liability
I voluntarily assume all risks associated with my participation, visit, and interaction with all animals, both known and unknown. Unless it is explicitly demonstrated that Lavender Waves Farm, LLC failed to exercise due care under the circumstances, I hereby release, waive, and forever discharge Lavender Waves Farm, LLC, its employees, property owners, and affiliates from any and all liability, claims, demands, or causes of action arising out of any loss, damage, illness, or injury (including death) that may be sustained by me or my property while on the premises.
4. Visitor Conduct and Safety Rules
I agree to abide by the following strict rules for my safety, guest safety, and the safety of the animals:
- Do NOT feed the animals anything other than the feed purchased directly from the farm store. Outside food can cause severe illness or death to livestock.
- Do not reach over, lean on, or climb fences to access animals unless explicitly permitted.
- Approach all animals calmly. Do not make sudden movements, loud noises, or attempt to climb on, ride, corral, or abuse the animals.
- Use all harvesting and agricultural tools safely, responsibly, and at my own risk.
- Minors: Absolute and continuous adult supervision is required for all children under the age of 18 at all times, especially around animals and harvesting equipment.
I have read this Liability Waiver, fully understand its terms, and understand that I am giving up substantial rights by signing it. I sign it freely and voluntarily.
